Overview

These Terms of Use ("Terms") govern your access to and use of vpch.com and any VPCH-operated subdomains or online services that link to these Terms. The Site is operated by Victoria Park Community Homes ("VPCH", "we", "us", "our"), a non-profit housing provider operating in Ontario, Canada.

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Purpose of the Site

The Site provides general information about VPCH, including housing, programs, services, properties, resident resources, community information, employment opportunities, forms, and contact options.

The Site is not a substitute for a signed tenancy agreement, official housing application process, written notice, legal advice, financial advice, or professional advice.

2. Information Is General and May Change

We make reasonable efforts to keep website information accurate and current. However, website content may contain errors, omissions, outdated information, or technical issues.

Property information, availability, rent amounts, eligibility criteria, wait-list information, program details, forms, deadlines, photographs, maps, and service information may change without notice. Photographs may be representative and may not show the exact unit, building, feature, or condition.

Binding information about a specific tenancy, application, unit, rent, subsidy, notice, maintenance matter, or legal right will be provided only through VPCH's formal written processes or as required by law. If there is a conflict between website content and an executed lease, formal notice, applicable law, service-manager requirement, funding agreement, or written VPCH communication, the formal document or legal requirement will govern.

3. No Professional Advice

Website content is for general information only and does not constitute legal, financial, tax, housing, medical, or other professional advice. You should obtain advice from a qualified professional before acting or relying on website information in a way that could affect your rights or obligations.

4. Acceptable Use

You agree not to use the Site for any unlawful, harmful, fraudulent, abusive, discriminatory, defamatory, or misleading purpose; attempt unauthorized access; interfere with Site security, availability, performance, or operation; upload or transmit malicious code; impersonate another person; submit false, incomplete, or unauthorized information; scrape or extract data in an excessive or unauthorized way; send unsolicited commercial electronic messages; or infringe the rights of VPCH or any third party.

VPCH may suspend, restrict, or block access to the Site where we reasonably believe these Terms have been violated or where necessary to protect the Site, VPCH, tenants, residents, staff, contractors, or the public.

5. Forms, Submissions, and Accounts

You are responsible for ensuring that information you submit through the Site is accurate, complete, and authorized. If you submit information on behalf of another person, you must have authority to do so.

Some features may require login credentials or access through a resident, applicant, or staff portal. You are responsible for keeping your credentials confidential and for all activity under your account, except where the activity is caused by VPCH's failure to use reasonable safeguards.

Personal information submitted through the Site is handled in accordance with our Privacy Policy.

6. Intellectual Property and Permitted Use

Unless otherwise stated, all content on the Site, including text, graphics, logos, designs, photographs, videos, documents, forms, page layouts, code, and other materials, is owned by VPCH or used with permission and is protected by copyright, trademark, and other intellectual-property laws.

You may view, download, and print Site content for personal, non-commercial, informational use, provided you do not remove copyright or attribution notices and do not modify the content in a misleading way.

You may not reproduce, republish, modify, distribute, sell, license, publicly display, incorporate into another product, scrape, systematically extract, or use Site content for commercial purposes without VPCH's prior written permission. Requests for permission may be sent to info@vpch.com.

7. Third-Party Links and Embedded Content

The Site may link to or embed third-party websites, forms, maps, videos, portals, resources, or services. These links are provided for convenience only. VPCH does not control third-party sites or services and is not responsible for their content, availability, accuracy, security, privacy practices, or terms.

A link does not mean that VPCH endorses the third party or its content.

8. No Warranty

The Site and its content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, VPCH makes no representations, warranties, or conditions of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, reliability, availability, security, fitness for a particular purpose, non-infringement, or uninterrupted operation.

9. Limitation of Liability

To the maximum extent permitted by law, VPCH and its directors, officers, employees, contractors, agents, and service providers will not be liable for any direct, indirect, incidental, consequential, special, punitive, or other damages arising from or related to your use of, inability to use, or reliance on the Site or any content on the Site.

Nothing in these Terms limits liability that cannot legally be limited.

10. Indemnity

You agree to indemnify and hold harmless VPCH and its directors, officers, employees, contractors, agents, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the Site, breach of these Terms, unauthorized submission of information, or violation of law or third-party rights.

11. Changes to the Site and Terms

VPCH may update, suspend, remove, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. The effective date at the top shows when this version took effect. Your continued use of the Site after changes are posted means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles. Any dispute relating to these Terms or the Site will be resolved in the courts of Ontario, unless applicable law requires otherwise.
